These Terms and Conditions (“Terms”) govern access to and use of Traxn, a product of Escappa Concept LLP (“Traxn”, “we”, “us”), including our websites, host dashboard, and software that powers guest booking pages. By creating an account or using Traxn, you agree to these Terms.
1. The service
Traxn provides tools for hosts of homestays, farmhouses, small resorts, and similar stays to publish websites, manage rooms or units, and collect booking deposits online. Traxn is a software platform. Traxn is not the lodging provider and is not a party to the stay contract between a host and a guest.
2. Accounts
- You must provide accurate registration information
- You are responsible for activity under your account
- You must keep login credentials confidential
- One site per host account under the current product model
3. Hosts and guest stays
Hosts set prices, availability, house rules, and stay policies. Guests contract with the host for the stay. Hosts are responsible for:
- Accuracy of listings, photos, and amenities
- Compliance with local hospitality, tax, and consumer laws
- Fulfilling confirmed bookings
- Handling guest disputes related to the property or stay
4. Payments
Guest deposits on Traxn booking sites are processed by Traxn through its payment provider (such as Razorpay). Hosts do not connect their own Razorpay or payment gateway. Hosts set a deposit percentage; Traxn handles guest checkout. Hosts receive deposit payouts via Traxn per the dashboard and payout process. Settlement timing for payouts, payment-provider fees on deposits, chargebacks, and refunds are subject to Traxn’s processes, the payment provider’s terms, and the host’s published refund policy. Traxn may show payment status in the dashboard.
5. Fees
Traxn may offer free and paid plans. Paid features (for example custom domains) require an active paid plan. Traxn does not take a commission on stay amounts through the product’s standard booking flow. Payment gateway fees are charged by the gateway, not as a Traxn OTA commission.
6. Acceptable use
You may not use Traxn to:
- Break the law or infringe others’ rights
- Upload malware or attempt unauthorized access
- Scrape, overload, or disrupt the service
- Misrepresent your identity or property
- Process payments for purposes unrelated to legitimate stays
7. Content and intellectual property
You retain ownership of content you upload. You grant Traxn a limited license to host, display, and process that content to operate the service. Traxn’s software, branding, and documentation remain Traxn’s property.
8. Availability
We aim for reliable uptime but do not guarantee uninterrupted service. We may change, suspend, or discontinue features with reasonable notice where practicable.
9. Disclaimers
Traxn is provided “as is” to the fullest extent permitted by law. We do not warrant that listings will generate bookings or that third-party payment or DNS services will be error-free.
10. Limitation of liability
To the maximum extent permitted by law, Traxn is not liable for indirect, incidental, special, consequential, or lost-profit damages, or for disputes solely between hosts and guests. Our aggregate liability arising from these Terms is limited to the fees you paid Traxn for the service in the three months before the claim.
11. Indemnity
You agree to indemnify Traxn against claims arising from your content, your property, your dealings with guests, or your breach of these Terms, except to the extent caused by Traxn’s willful misconduct.
12. Termination
You may stop using Traxn at any time. We may suspend or terminate accounts that violate these Terms or create risk for the platform or payment partners.
13. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts in India shall have exclusive jurisdiction, subject to mandatory consumer protections that may apply.
14. Changes
We may update these Terms. Material changes will be reflected by the “Last updated” date. Continued use after changes constitutes acceptance.
